3.1.

The Operator provides the user with access to the RusProm platform and related digital services within the selected tariff, paid invoice, agreed demo access or other written agreement of the parties.

3.2.

The platform is intended for business and procurement interaction, searching for and vetting manufacturers, creating the platform catalog, posting and confirming company and product information, submitting requirements, processing requests, preparing and exchanging commercial offers, as well as other procurement and information scenarios. The platform is not a government information system and is not an official source of registry information.

3.3.

The Operator provides technical and information infrastructure. Unless otherwise expressly agreed in a separate agreement, the Operator is not a party to a supply, procurement, contract work or other agreement between the buyer and the manufacturer, and does not assume

obligations of the supplier, buyer, agent, commission agent, freight forwarder, transaction guarantor, or official electronic trading platform.

3.4.

Certain platform functions may be in test, pilot, or demo mode. Such functions are provided "as is" and may be changed, supplemented, or disabled by the operator without any obligation to keep them unchanged.

3.5.

The mobile apps provide business correspondence, file exchange, and voice messages, as well as notifications. Availability of these and other features depends on the role, user permissions, and the organization's access terms for the platform.

4. Procedure for Concluding the Agreement and Acceptance

4.1.

Acceptance of the offer is deemed to be any of the following actions: payment of the invoice in full or in part; registration in the personal account; clicking the button or checking the box agreeing to the offer; submitting a connection request; obtaining and using credentials; actual use of the platform functionality after access is granted; performing a publication action. Payment of the invoice constitutes full and unconditional acceptance of this offer for the selected plan specified in such invoice. The publication action constitutes a separate acceptance of the terms of sections 9 and 11 of this offer with respect to the catalog, photographs, trademarks, and registry links.

4.2.

Acceptance is full and unconditional. A User accepting the offer on behalf of an organization confirms the authority to act on behalf of such organization and to undertake obligations under this offer.

4.3.

If the terms of the invoice, contract, commercial offer, or addendum differ from this offer, the special terms of such document shall prevail with respect to the relevant tariff, term, price, and scope of access.

4.4.

The Operator may refuse registration, connection or extension of access without stating reasons if the Operator has reasonable doubts as to the accuracy of the information, the user's authority, the security of platform use, the legality of the declared scenario, or the business reputation of the user or the organization represented by the user.

5. Procedure for Providing Access

5.1.

Access is provided after payment confirmation, account activation, completion of the identification or verification procedures required by the operator, or sending the user login data.

5.2.

The Operator may request additional information and documents from the user necessary for identification, invoicing, verification of authority, contract performance, information security, and protection of the platform from misuse.

5.3.

Access is deemed provided from the moment login data is sent, the account is activated, paid functionality is opened, or the user is notified that access is ready.

5.4.

The user independently ensures the availability of equipment, software, internet access, electronic signature means, and other technical conditions necessary to use the platform, unless otherwise expressly agreed by the parties.

5.5.

The Operator may carry out preventive, scheduled and emergency maintenance, updates, and interface and functionality changes. During such maintenance, certain platform functions may be temporarily unavailable.

5.6.

The mobile application is an additional way to access the platform. An existing RusProm account is used to sign in. Registration, tariff purchase, and payment within the mobile application are not provided; connection and settlements are made outside the app in the procedure established by the operator. Installing the app does not in itself provide paid access, activate a tariff, or change the price, term, or scope of previously provided access. Available functions are determined by the user's role and rights, verification status, and the organization's access terms.

6. Cost, Settlements and Closing Documents

6.1.

Access cost is determined by the selected tariff, invoice, commercial offer, or other document of the operator. Current tariff names, prices, and terms are specified in clause 6.6 of this offer and on the website.

6.2.

Payment shall be made in the manner and within the time limits specified in the invoice or other agreed document. The payment obligation is deemed fulfilled from the moment the funds are credited to the operator's settlement account.

6.3.

VAT is charged or not charged in accordance with the operator's applicable tax regime and the wording specified in the invoice and closing documents.

6.4.

If the user does not submit reasoned written objections regarding the scope of access provided within 5 business days after the end of the paid period or receipt of the acceptance certificate/UPD, the access and services shall be deemed accepted in full, unless otherwise agreed by the parties.

6.5.

In case of late payment, the operator is entitled to suspend access, restrict individual functions, refuse tariff renewal, delete unpaid requests or other unpaid results, and also recover the debt and losses in accordance with the procedure established by law.

6.6.

The current RusProm platform price list includes the following plans.

  • "For manufacturers": 0 (zero) rubles, access term 3 (three) calendar months from activation. The plan is intended only for users with the "Manufacturer" role.
  • "Manufacturer / Buyer": RUB 29,900 (twenty-nine thousand nine hundred rubles), access term 1 (one) year. The tariff is intended for one selected role only: either product catalog publishing ("Manufacturer" role) or purchasing ("Buyer"). The tariff does not provide purchasing and catalog functions in one account at the same time.
  • "Team": 59,900 (fifty-nine thousand nine hundred) rubles, access term 1 (one) year. The plan is intended for manufacturers who list products in the catalog and additionally submit commercial quotation requests.
6.7.

The "For Manufacturers" tariff is provided once for one taxpayer ID. Re-registration with the same taxpayer ID does not provide a repeated access period for 0 (zero) rubles. The tariff does not include tenders, fleet information, or arbitration cases in Radar. No invoice is issued for the initial connection, since the tariff cost is 0 (zero) rubles. At the end of 3 (three) calendar months, access is terminated and is not automatically renewed for 0 (zero) rubles. Further use of the platform is possible after selecting and paying for any active paid tariff.

6.8.

The user role (“Manufacturer” or “Buyer”) is selected separately from the plan upon connection and is recorded in the request and invoice, unless otherwise implied by the selected plan.

The "Team" tariff does not create a separate legal status
It is intended for a manufacturer scenario that combines catalog placement and RFQ submission.
6.9.

Payment of the invoice constitutes full and unconditional acceptance of this offer for the selected tariff specified in the invoice, in accordance with clause 4.1 of this offer and Article 438 of the Civil Code of the Russian Federation. Access is provided after payment is credited to the operator's settlement account, unless otherwise stated in the invoice. Previously issued invoices remain valid on the terms specified in such invoices.

7. Rights and Obligations of the Controller

7.1.

The Operator undertakes to provide the user with access to the platform within the paid or agreed tariff, provided the user complies with this offer, the user agreement, security requirements and the legislation of the Russian Federation.

7.2.

The Operator may change the structure of the platform, the scope of functions, tariffs, access rules, interfaces, technical requirements and verification procedure, provided such changes do not contravene mandatory legal requirements or specifically agreed terms with the user.

7.3.

The Operator may verify the user's information, documents, activity and content, including by using open sources, state and commercial registers, internal procedures, inquiries from other users, technical logs, information security tools and other lawful sources.

7.4.

The Operator may send the user service notifications related to registration, security, payment, access, requests, inquiries, commercial offers, changes to documents and operation of the platform.

7.5.

The Operator may engage contractors, technical service providers, hosting providers, telecommunications operators, email, analytics and support services to the extent necessary to ensure the operation of the website and platform.

8. Rights and Obligations of the User

8.1.

The user undertakes to use the platform in good faith, reasonably, only for lawful purposes, and in accordance with this offer, the user agreement, interface rules, and the applicable legislation of the Russian Federation.

8.2.

The user undertakes to provide accurate, up-to-date, and complete information about themselves, the organization represented, authority, products, production capabilities, requirements, documents, prices, certificates, details, and other information transmitted through the platform.

8.3.

The user must independently verify the content of information, documents, and commercial offers submitted by them, as well as the compliance of their actions with procurement, antitrust, tax, advertising, personal data, trade secret, intellectual property, and other applicable legal requirements.

8.4.

The user is not entitled to transfer account credentials to third parties, use another person’s account, bypass access restrictions, attempt unauthorized access, interfere with platform operation, or copy or export data beyond the permitted functionality.

8.5.

The user must promptly notify the operator of account compromise, erroneous transfer of data, discovery of inaccurate information, security breach, loss of representative authority, or any other circumstance affecting the lawful use of the platform.

9. Special Terms for Manufacturers and Suppliers

9.1.

The manufacturer confirms that information on its legal status, production capacities, products, certificates, product origin, prices, lead times, stock levels, photographs, videos, and other information is accurate and does not mislead buyers, the operator, government authorities, or other persons.

9.2.

The manufacturer must promptly update information on products, prices, availability, certificates, document validity periods, production capabilities, and supply limitations.

9.3.

The manufacturer may not publish information about products whose manufacture, sale, supply, export, import, or circulation is prohibited or restricted by law without the necessary rights, permits, licenses, certificates, and other documents.

9.4.

Posting information about a manufacturer or product on the platform is not a guarantee of contract award, order receipt, passage of a procurement procedure, approval by a government authority, inclusion in an official register, or confirmation of compliance with the requirements of a specific procurement.

9.5.

The Operator generates the platform catalog, including reference cards linked to the manufacturer's organization by identifiers, including Tax ID and other information from open sources. The creation of a reference card does not require separate consent from the manufacturer and does not mean approval by a government authority, the operator of a state information system, or inclusion of the platform in the perimeter of such system.

9.6.

The legal grounds for creating and displaying reference cards are: use of publicly available information at the discretion of any person (Article 7 of Federal Law No. 149-FZ of 27.07.2006); use of information access to which is not restricted; absence of copyright protection for facts, information, and product characteristics as such; independent structuring, normalization, and presentation of information by the operator.

9.7.

A reference card may include the product name, item number, normalized technical and other characteristics, classification codes, manufacturer details and other factual data. The reference card does not contain product photos and does not display a link to the registry record. Reference cards are available to users within the paid plan, demo access or other agreed access.

9.8.

The publication action is not required for continued display of already created reference cards and is not a condition for the lawfulness of their display. By using the platform, the manufacturer acknowledges this procedure and may not demand deletion of a reference card solely on the ground that it did not perform the publication action, if the card is based on publicly available information and linked to its organization.

9.9.

The Operator does not replicate the interface of third-party information systems, does not pass off the platform catalog as an official state catalog or register, and does not claim that the platform's information has the status of an official publication of a government authority. The Operator may indicate that reference information has been generated on the basis of open sources and processed independently. The Operator deletes or hides information that has ceased to be publicly available, has been removed from the open source, or has been withdrawn by an authorized authority.

9.10.

Photos, images, logos, video materials and links to registry records are not displayed to platform catalog users before publication, except for materials that the manufacturer has independently uploaded to the platform. Performing the publication action opens a confirmed publication for all cards matched to the organization, unless the manufacturer has restricted the list before clicking.

9.11.

The publication action is performed by a person authorized in the manufacturer organization’s personal account. Such person confirms that they have authority to act on behalf of the organization. All actions in the organization account, including publication, withdrawal of publication, replacement of photos, and restriction of the product list, are deemed actions of that organization. The organization bears the risk of granting employees access to the account.

9.12.

From the time of publication, the manufacturer grants the operator a free simple (non-exclusive) license for the entire term of exclusive rights, worldwide, with the right to sublicense to buyers and technical contractors to the extent necessary for the operation of the platform, to use:

  • photos, images, videos, descriptions and other materials relating to published products, including materials previously posted by the manufacturer in public sources;
  • trademarks, trade names, and logos displayed in photographs and product information, solely for identifying the product and manufacturer in the platform catalog, requests, and commercial offers;
  • instructions and placement of a hyperlink to the registry record.
9.13.

The license under clause 9.12 includes reproduction, copying to the operator's infrastructure, processing for technical purposes, making available to platform users, inclusion in RFQs, export and downloading within the platform functionality. The manufacturer may not claim that the image file was obtained by the operator from a publicly available source if the manufacturer has confirmed the right to dispose of the relevant object.

9.14.

The manufacturer warrants that it holds rights to the materials provided or has obtained the necessary consents from authors, photographers, licensors, and trademark rights holders. The manufacturer undertakes, at its own effort and expense, to settle third-party claims and indemnify the operator for losses caused by the inaccuracy of such warranty.

9.15.

The manufacturer may withdraw a confirmed publication in full or in part with respect to individual items, replace photographs, and prohibit the display of individual products. After withdrawal, the operator hides the photographs and the link to the registry entry. The reference card may be retained. Withdrawal does not terminate the license with respect to copies already lawfully included in submitted inquiries, quotations, contract performance archives, and backup copies to the extent required by law.

9.16.

If several organizations claim one record, the operator may rely on a match of the TIN and other identifiers with public sources, hide the photos and registry link, request documents and refuse verified publication until the ambiguity is resolved. Priority is given to the organization whose details are contained in the relevant public record, unless otherwise follows from the documents and verification.

9.17.

The link to the registry record indicates an open source and does not replace an extract, opinion or other document issued by a government authority or the operator of a state information system. The operator independently hides or updates the link if the record is removed, its validity has expired, or the information is no longer publicly available.

9.18.

A confirmed publication of products with photos may constitute advertising within the meaning of Federal Law No. 38-FZ of 13.03.2006. The advertiser is the manufacturer. The Operator is entitled to distribute such advertising as the platform owner within the catalog functionality. The manufacturer guarantees the accuracy of the advertising and the availability of rights to the advertised product and materials.

9.19.

The Operator records the publication action: the account, organization, date and time, version of the offer, the set of affected cards and available technical session data. Such information serves as proof of acceptance of the catalog terms.

9.20.

The publication action does not transfer to the operator the exclusive right of a third party database producer and does not replace the permission of the rightholder of such database to extract it as such. Reference cards continue to be used on the basis of clause 9.6 of this offer. After the publication action, the operator is entitled to store copies of photographs on its infrastructure and update the factual information in the reference card from open sources.

10. Special Terms for Buyers and Customers

10.1.

The buyer independently determines procurement requirements and verifies the applicability of 44-FZ, 223-FZ, the national regime, internal procurement regulations, corporate policies, compliance requirements, and other applicable rules.

10.2.

Information, reports, selections, commercial offers, information about manufacturers, and other materials obtained through the platform are a tool for procurement and analytical work. Unless otherwise expressly agreed by a separate contract, the operator does not replace the user's legal, financial, technical, procurement, or antitrust review.

10.3.

The buyer is not entitled to use the platform to simulate competition, create formal document workflows without a real request, obtain fictitious commercial offers, make affiliated supplier selections, pressure manufacturers, collect commercial information outside a lawful purpose, or engage in other unfair actions.

10.4.

Within the paid or demo access, the buyer is entitled to view the platform’s catalog cards, save them, include them in RFQs, export them, and use them for internal procurement, analytical, and contractual work. Such right does not include creating a competing database, mass export outside the functionality, selling the catalog, parsing, or any other use beyond the purpose of the platform.

10.5.

The buyer understands that the reference card is for informational purposes only and is not an official extract, opinion, or any other document of a government authority. The presence of a link to the register entry after confirmed publication does not exempt the buyer from independently verifying the relevance of the information in the public source.

11. User Content and Documents

11.1.

The user retains rights to the content uploaded by them, but grants the operator the right to use such content to the extent necessary for platform operation, request processing, posting of product cards, selection, verification, document generation, transmission to recipients, storage, backup, technical processing, and contract performance. With respect to materials of confirmed publication, the license granted under Clause 9.12 of this offer applies.

11.2.

The user warrants that they have all rights and authority to transfer to the controller the posted information, documents, images, videos, logos, trademarks, certificates, price lists, and other materials. The act of publication means that this warranty extends to photographs and other materials of the respective products, including if such materials were previously posted by the manufacturer in a publicly available source.

11.3.

The Operator may delete, hide, archive, correct technical errors, restrict display, mark as unverified, or send for review information and materials that violate this offer, the user agreement, third-party rights, security requirements or the legislation of the Russian Federation.

11.4.

The Operator may store copies of information, documents, technical logs and the user's actions for the period necessary to perform the contract, protect the Operator's rights, confirm the circumstances of platform use, resolve disputes, comply with legal requirements and ensure security.

12. Suspension, Blocking, and Termination of Access

12.1.

The Operator has the right to temporarily restrict, suspend, block in whole or in part, refuse registration, refuse renewal, delete or hide an organization profile, product, request, commercial offer, message, document, or terminate access for a buyer, manufacturer, supplier, representative, or affiliated organization if there is a violation of this offer, the user agreement, security requirements, the legislation of the Russian Federation, or if there are reasonable signs of such a violation.

12.2.

For temporary blocking, reasonable suspicion or a combination of risk indicators is sufficient. The Operator is not required to wait for a court decision that has entered into force, a decision of the regulatory authority, or the full completion of an internal review if continued access may create risk for the platform, the operator, other users, procurement procedures, personal data, trade secrets, business reputation, or information security.

12.3.

The grounds for restricting, blocking, or terminating access include, in particular:

  • providing inaccurate, incomplete, outdated, contradictory, or misleading information about the user, organization, authority, production capacities, goods, services, prices, product availability, delivery times, certificates, or other documents;
  • absence, termination or non-confirmation of the representative’s authority, use of another person’s data, registration on behalf of an organization without the consent of such organization;
  • falsification, forgery, distortion, unlawful use or substitution of documents, certificates, declarations, extracts, price lists, commercial offers, seals, signatures, logos, photographs, video materials, geolocation data or other evidence;
  • signs of a fictitious manufacturer, fake manufacturer, intermediary, trading house, importer, or reseller posing as a manufacturer, including signs of no own production capacities, personnel, equipment, warehouses, raw materials, permit documentation, or actual ability to produce the declared goods;
  • signs of fictitious import substitution, "relabeling", unlawful claiming of Russian origin of goods, use of someone else's certificates, non-compliance of the goods with registry data, declarations, passports, labeling, or origin documents;
  • discrepancy between user information and data in the Unified State Register of Legal Entities, the Unified State Register of Individual Entrepreneurs, the Federal Tax Service, the Federal Bailiff Service, the register of unscrupulous suppliers, bankruptcy registers, arbitration cases, sanctions and restriction lists, licenses, permits, sectoral or other open and lawfully used sources;
  • information about liquidation, cessation of operations, bankruptcy, false information in the Unified State Register of Legal Entities/Individual Entrepreneurs, mass registration address, disqualified persons, material tax, enforcement, court, compliance, or reputational risks, if such circumstances make use of the platform risky for the operator or other users;
  • refusal to undergo identification, verification, re-verification, video audit, provide requested documents, confirm authority, update information, or remedy identified violations within a reasonable period;
  • posting prohibited, restricted, counterfeit, sanction-risky, hazardous, unlawful, or non-compliant goods, works, services, materials, or offers without the required permits and documents;
  • violation of laws on procurement, competition, advertising, personal data, trade secrets, intellectual property, export control, currency regulation, taxes, anti-corruption, money laundering, or other mandatory requirements;
  • signs of cartel collusion, affiliation, simulated competition, coordinated commercial offers, fictitious justification of the initial maximum contract price, price manipulation, substitution of independent offers, or participation in unfair procurement scenarios;
  • use of the platform to circumvent the interaction model, tariff, lead mechanism, paid verification, or other commercial terms established by the operator, including collecting users' contacts in order to move interaction out of the platform in violation of the agreed rules;
  • spam, mass mailings without legal grounds, intrusive advertising, insults, threats, pressure on other users, bad-faith negotiations, publication of knowingly false reviews or complaints;
  • breach confidentiality, disclose trade secrets, or improperly transfer requests, quotations, prices, documents, personal data, files, or other information to third parties;
  • attempts to hack, brute-force passwords, bypass authorization, exploit vulnerabilities, DDoS attacks, upload malicious code, interfere with platform operation, unauthorized scanning, parsing, scraping, bulk data export, or other technically harmful behavior;
  • transferring the account to third parties, shared use of a login and password by multiple persons without approval, sale of access, creating multiple accounts to bypass restrictions, abuse of demo access, promotions, or trial periods;
  • non-payment, late payment, unjustified payment reversal, payment fraud, use of another party's payment instruments, violation of financial terms, or refusal to sign closing documents when access was actually provided;
  • the controller's receipt of complaints from users, banks, government authorities, rights holders, counterparties, or other persons if the content of the complaint indicates a material risk of violation or bad faith on the part of the user;
  • the existence of other circumstances that the operator reasonably considers a threat to the safety, legality, reliability, business reputation, normal operation of the platform, or the rights of third parties.
12.4.

The Operator may apply one or more of the following measures: request explanations and documents; temporarily hide a card, product, document, commercial offer or request; restrict certain functions; prohibit publication of new materials; suspend sending messages; change the profile status to "under review"; refuse to grant verification status; revoke verification status; block the account; terminate the agreement; refuse re-registration; transfer information to authorized authorities or rights holders if there are legal grounds.

12.5.

The Operator may not disclose to the user internal anti-fraud algorithms, scoring, risk models, signal sources, verification details or information whose disclosure may reduce the effectiveness of platform protection, infringe third-party rights, disclose trade secrets or personal data, or create a risk of bypassing the rules.

12.6.

Where possible, the Operator notifies the user of a block via the personal account, email or another available channel. In urgent cases related to security, illegality, complaints, risk of data leakage, technical attack or reputational damage, a block may be applied without prior notice.

12.7.

The user may send reasoned objections and supporting documents to info@rusprom.group within 5 business days from receipt of the notice, unless the controller specifies a different period. The controller will consider the request within a reasonable time, taking into account the complexity of the verification, the volume of documents, and the need to request information from third parties.

12.8.

Based on the review results, the Operator may restore access in full or in part, maintain restrictions, change the verification status, require remediation of violations, offer a new procedure for using the platform, or permanently terminate access.

12.9.

If blocking or termination of access is caused by the user's breach, amounts paid for access actually provided are non-refundable. A refund for the unused period may be granted at the operator's discretion or in cases expressly provided by law or a separate agreement between the parties.

12.10.

Blocking, suspension, or termination of access does not release the user from the obligation to pay for access actually provided, compensate losses, cease the infringement, remove unlawful materials, maintain confidentiality, and fulfill other obligations incurred before the blocking date.

13. Returns and Termination of the Agreement

13.1.

The agreement is valid for the paid period or until access is terminated on the grounds provided for in this offer or in a separate agreement between the parties.

13.2.

A refund is considered by the operator taking into account the actually provided access, the volume of services rendered, the period used, special tariff terms, the reasons for refusal, and applicable law.

13.3.

If the user voluntarily refuses to use the platform after access has been provided, the operator is entitled to withhold the cost of access actually provided and any expenses incurred, unless otherwise agreed by the parties.

13.4.

In the event of a material breach by the user of the offer terms, the operator is entitled to terminate the agreement unilaterally out of court by sending notice to the user or by changing the access status in the personal account.

14. Limitation of Liability

14.1.

The platform is provided within the available technical and organizational capabilities. The Operator does not guarantee continuous, error-free, or fully uninterrupted operation of the platform unless otherwise expressly agreed in a separate contract.

14.2.

The Operator is not responsible for the content, accuracy, completeness and timeliness of information, documents and commercial offers posted or transmitted by users, except where the duty of independent verification has been expressly assumed by the Operator in a separate agreement.

14.3.

The Operator is not liable for the actions of buyers, manufacturers, suppliers, representatives, banks, telecommunications operators, hosting providers, certification centers, state information systems, external registers, analytics services and other third parties.

14.4.

The Operator does not guarantee the conclusion of a transaction, receipt of an order, winning a procurement, compliance of the product with the requirements of a specific procedure, budget savings, passing an inspection by a supervisory authority, or the absence of claims by third parties, unless such guarantee is expressly provided for in a separate written agreement.

14.5.

The operator's total liability under this offer is limited to the amount actually paid by the user for the last paid access period within which the basis for liability arose, unless another limitation is prohibited by mandatory provisions of law.

14.6.

The Operator is not liable for lost profits, indirect losses, reputational damage, loss of data due to the user's fault, unauthorized access resulting from the user's violation of security rules, or for the consequences of the user's use of information from the platform without independent verification.

15. Intellectual Property

15.1.

Exclusive rights to the website, platform, software code, interfaces, design, database structure, texts, graphics, corporate identity elements, trademarks, and other results of intellectual activity belong to the operator or are used by it on lawful grounds.

3. Categories of Personal Data

3.1.

The Operator may process the following categories of personal data:

  • surname, first name, patronymic;
  • position, role in the organization, information on the representative’s authority;
  • email address, phone number, other contact details;
  • information about the organization represented by the user: name, Taxpayer Identification Number, Primary State Registration Number/Primary State Registration Number for Individual Entrepreneurs, address, website, industry, and details;

  • device and app information: platform, device manufacturer and model, operating system version, app version and build number;
  • application installation identifier, session and account identifiers, push token, notification delivery provider, notification settings, and technical device binding identifiers, events, and the associated platform object.
3.2.

The Operator does not intend to process special categories of personal data, biometric personal data, information about private life, political views, religious beliefs or health status. The user must not transmit such information through the website and platform forms unless the Operator has expressly requested it on a lawful basis.

3.3.

If the user enables app unlocking using Face ID, Touch ID, or other device-supported biometric verification methods, verification is performed by the device operating system. The app receives the verification result; the face image, fingerprint, and biometric templates are not transmitted to the RusProm server for this function. Voice messages are processed as message content, not for biometric identification.

4. Purposes of Personal Data Processing

  • registration, identification, authentication, and account management;
  • processing requests for connection, demo access, plans, feedback, consultations, and other inquiries;
  • conclusion and execution of contracts, issuing invoices, granting access, preparing closing documents, supporting users;
  • verification of representatives' authority and the reliability of information about the organization;
  • ensuring platform operation, information security, prevention of fraud, abuse, unauthorized access, spam, technical attacks, and other risks;
  • business correspondence between users, file and voice message transfer, communication with users, sending service notifications, including push notifications about messages, requests and other platform events, responses to inquiries, information about requests, access, payment, security, and document changes;
  • traffic analytics, improvement of site structure, interface quality, stability, advertising and communication scenarios;
  • sending informational, news, marketing, and advertising messages with separate consent;
  • compliance with legal requirements, response to requests from government authorities, protection of the rights and legitimate interests of the operator, users, and third parties, and dispute resolution.

5. Legal Bases for Processing

  • consent of the personal data subject;
  • necessity of processing for the conclusion and performance of a contract to which the personal data subject, their representative, beneficiary, or a party represented by them is a party;
  • performance of the operator's duties required by the legislation of the Russian Federation;
  • the exercise of the rights and legitimate interests of the operator or third parties, provided that the rights and freedoms of the data subject are not thereby violated;
  • processing publicly available information and information from official registers to the extent permitted by law.

6. Actions with Personal Data

6.1.

The Operator may collect, record, systematize, accumulate, store, clarify, update, modify, extract, use, transfer, provide, grant access to, depersonalize, block, delete and destroy personal data using automated means and without such means.

6.2.

Processing of personal data of citizens of the Russian Federation, including recording, systematization, accumulation, storage, clarification, and retrieval, is carried out using databases located in the territory of the Russian Federation, in cases and according to the procedure provided by the legislation of the Russian Federation.

6.3.

The Operator does not make decisions that produce legal effects in relation to the personal data subject or otherwise affect their rights and legitimate interests solely on the basis of automated processing of personal data, unless otherwise provided by law or by a separate consent of the subject.

6.4.

Depending on the interface and features used, the mobile app stores on the device data needed for sign-in and operation: session data and settings, message drafts, local copies of correspondence data, and temporary files of selected attachments and voice recordings. Data may be stored in the app storage and the built-in web interface. System protection mechanisms are used for keys of protected local storage; this does not mean that all temporary files and caches are protected in the same way. Local storage on the device differs from storing sent materials on the platform server.

6.5.

Microphone permission is requested to record a voice message. The recording is first created on the device; transfer of the recording to the chat is performed when the user sends it. Files, images, and videos are added at the user's discretion through the device's available file selection tools. Notification permission is used to display push notifications; enabling them is done by the user in the app settings subject to system permissions. These permissions can be changed in the device settings. Disabling a permission limits the corresponding function and does not itself delete data already transmitted.

7. Transfer of Personal Data to Third Parties

7.1.

The Operator may transfer personal data to third parties to the extent necessary to achieve the purposes of processing, including hosting providers, telecommunications operators, email services, technical support contractors, developers, infrastructure administrators, analytics services, accounting and legal support services, payment and banking organizations, if such transfer is necessary for performance of the contract or law.

7.2.

The Operator may provide personal data to government authorities, courts, law enforcement agencies, regulatory authorities and other authorized persons in the cases and in the manner provided for by the legislation of the Russian Federation.

7.3.

The site may use web analytics services, including Yandex.Metrica and, if the configuration is enabled, Google Analytics. Such services may receive cookies, IP address, browser information, device information, and information about user actions on the site within the scope of the user's settings and consents.

7.4.

Cross-border transfer of personal data is permitted only if there are legal grounds, compliance with the requirements of the legislation of the Russian Federation, and informing the personal data subject in the necessary cases. If a separate service entails cross-border transfer, the operator uses it only if there are appropriate legal grounds and settings.

7.5.

The Operator does not publish personal data in publicly accessible sources without the separate consent of the data subject, unless otherwise expressly provided by law or related to the publication of information about the representative of an organization at the request of such organization on a lawful basis.

7.6.

Apple Push Notification service (APNs) on iOS and Firebase Cloud Messaging (FCM, Google service) on Android are used to deliver mobile push notifications. The Operator transfers the corresponding push token and technical notification data to the relevant service: the event type and identifier, device binding identifiers, and the associated platform object. The notification contains a neutral message about a new event; chat text, attachments, and voice recordings are not included in the push notification. The user opens the content in the platform after access verification.

7.7.

When registering an Android app in FCM and operating the notification service, Firebase processes the Firebase Installation ID (FID) and technical data necessary for the service to operate. FCM is used to deliver notifications; its use alone does not mean that Google Analytics is connected or that correspondence is transferred to the analytics service. The provisions of clause 7.4 also apply to notification delivery services.

7.8.

Messages, attachments, and voice recordings are processed by the platform infrastructure and made available to participants in the relevant correspondence within the limits of their access. When transferring data of other persons, the user must have a lawful basis for such transfer.

8. Processing and Retention Periods

8.1.

Personal data are processed no longer than required by the purposes of processing, the terms of the contract, limitation periods, accounting, tax, archival, procurement and other applicable legislation, as well as the need to protect the controller's rights and resolve disputes.

8.2.

Data submitted through requests and inquiries are retained for the period required to process the inquiry, continue interaction, confirm performance of obligations, and protect the operator’s rights.

8.3.

Account data are processed for the duration of the account and for a reasonable period after its termination, if retention is necessary to comply with the law, confirm access, make settlements, ensure security, handle claims, or protect the operator’s rights.

8.4.

After the processing purposes are achieved, consent is withdrawn in the absence of other legal grounds, or the need for processing personal data is lost, the personal data shall be deleted, destroyed, or anonymized in accordance with the procedure established by the operator and the legislation of the Russian Federation.

8.5.

The rules of this section also apply to mobile app data, including messages, attachments, voice recordings, device information, and push tokens. Logging out of the app, disabling push notifications, or deleting the app does not amount to deleting the account or the data previously transmitted to the platform. A request to process or delete such data may be submitted in accordance with Section 10 of this Policy.

9. Rights of the Data Subject

  • receive information about the processing of their personal data;
  • to request correction, blocking, or deletion of personal data if they are incomplete, outdated, inaccurate, unlawfully obtained, or not necessary for the stated purpose of processing;
  • withdraw consent to the processing of personal data;
  • to demand termination of unlawful processing;
  • appeal the actions or inaction of the operator to the authorized body for the protection of personal data subjects' rights or to a court;
  • to exercise other rights provided for by the legislation of the Russian Federation.

10. Procedure for Data Subject Requests

10.1.

Requests related to personal data processing are sent to info@rusprom.group or to the operator's legal address.

10.2.

The request should include full name, contact details for a response, information enabling identification of the data subject and their interaction with the controller, the substance of the request, and proof of authority of the representative if the request is submitted by a representative.

10.3.

The Operator may request additional information necessary to identify the applicant, confirm authority, and prevent unlawful disclosure of personal data to third parties.

11. Personal Data Protection Measures

  • appointment of responsible persons and adoption of local documents on personal data processing;
  • restriction and segregation of access to personal data;
  • use of authentication and access control tools;
  • keeping logs of security events and user actions;
  • backup and recovery of data;
  • application of organizational and technical measures to protect against unlawful or accidental access, destruction, alteration, blocking, copying, provision, distribution, and other unlawful actions;
  • vendor screening and limiting data transfer to the amount necessary for the relevant purpose;
  • updating security measures taking into account the nature of the data, threats, and the operator's technical capabilities.

12. Policy Changes

12.1.

The Operator may amend this Policy. The current version is posted at https://rusprom.group/personal-data#personal-data-policy.

12.2.

Continued use of the website and platform after the publication of a new version means that the user has acknowledged the new version with respect to matters that do not require separate consent. If separate consent is required to continue processing, the operator requests such consent separately.
